As of 2023, Florida law states that a negligence claim, the type of lawsuit you bring when you are injured in a car accident, must be brought within two years. Florida Statute §95(4)(d) applies when a loved one succumbs to their injuries, known as wrongful death. These cases also must be brought within two years, whether death occurs during the accident, or your family member succumbs weeks or months later.
In addition, different time limits apply to accidents involving government entities. For example, if you’re in an accident with a state employee, agent or volunteer, you may sue, but special rules apply. The employee’s state agency and the Florida Department of Financial Services must have written notice of your claim within three years. Further, you may not file suit until the conclusion of a 180-day investigation by the state. Monetary recovery against the state is limited by statute. Requesting a more significant amount involves an application to the State Legislature.
